These Terms and Conditions ("Terms") apply to the Home Renovation Services provided by Atoz Home Essentials ("Company," "we," "our," or "us"). By engaging our services, you ("Client," "you," or "your") agree to the following terms. Please read them carefully.
Scope of Services
- The Company provides home renovation services as outlined in the project agreement signed by both parties. Services may include but are not limited to remodeling, repairs, installations, and other home improvement tasks.
- Any additional services not specified in the original agreement will be subject to a new estimate and additional charges.
Estimates and Payments
- The initial estimate provided is based on the scope of work discussed. Final costs may vary depending on material prices, unforeseen structural issues, or changes requested by the Client.
- Payment terms, including deposits and installment schedules, will be outlined in the agreement. Failure to pay as per the schedule may result in project delays or termination.
- A late fee of 2% may be applied to payments delayed beyond 20 days of the due date.
Project Timeline
- The estimated timeline for project completion will be provided in the agreement. Delays may occur due to factors beyond our control, such as weather, material shortages, or unforeseen structural issues.
- We will make every effort to keep you informed of any delays and provide updated completion dates.
Client Responsibilities
- The Client is responsible for providing safe access to the property and any necessary permissions for project completion.
- Utilities (e.g., water, electricity) must be available at the site during working hours. Any costs related to utility disruptions will be the Client’s responsibility.
- It is the Client’s responsibility to secure or remove personal belongings from the project area.
Changes to Project Scope
- Any changes requested by the Client after the agreement is signed must be documented and may result in additional charges and timeline adjustments.
- The Company reserves the right to refuse any requested changes if they significantly alter the original project scope.
Materials and Warranties
- We will provide materials specified in the project plan. If a specified material is unavailable, we will consult the Client for approval on substitutions.
- Workmanship is covered by a [duration] warranty. Material warranties will vary and are governed by the manufacturer’s policies.
Liability and Insurance
- The Company is insured and will take reasonable precautions to protect the Client's property. However, the Company is not liable for any damages resulting from structural deficiencies, pre-existing conditions, or force majeure events.
- The Client is advised to maintain homeowner’s insurance to cover unforeseen incidents.
Termination & Cancellation
- Either party may terminate the agreement by providing written notice. The Client will be responsible for payment for all completed work and materials ordered before termination.
- If the Client cancels the project after it has begun, a cancellation fee of 25% of the remaining balance may apply.
Dispute Resolution
- Any disputes arising from this agreement will be resolved through negotiation in good faith. If a resolution cannot be reached, both parties agree to submit to mediation or arbitration, as appropriate.
- Legal fees and other costs of dispute resolution will be allocated as determined by the mediator or arbitrator.
Modification of Terms
The Company reserves the right to amend these Terms at any time. Notice of any changes will be provided in writing, and continued use of our services after modification indicates acceptance of the new terms.
